Pain Journey Terms

These terms apply to your use of the Pain Journey Android app. Please read them before using the app.

Pain Journey is provided by Benchwink Ltd, a company registered in the United Kingdom.

These app terms are separate from the terms that apply to the Benchwink online shop and purchases of physical products from that shop.


1. Accepting these terms

By downloading, installing or using Pain Journey, you agree to these terms. If you do not agree, do not use the app.

You must also comply with the applicable Google Play terms. If these terms conflict with a mandatory Google Play requirement concerning distribution or payment through Google Play, that requirement will apply to that extent.


2. Who may use Pain Journey

Pain Journey is intended for adults. You must be at least 18 years old to use it independently. It is not designed or offered directly for use by children.

You may use Pain Journey only where doing so is lawful. If you use it on behalf of another adult, you are responsible for having their permission and protecting their information.


3. What Pain Journey is for

Pain Journey is a personal diary that helps you record pain or discomfort, including its location, intensity, character, impact, associated notes and relevant medicines. It can display your records in a history, calendar, trends and appointment summary.

The information displayed by Pain Journey reflects what you recorded. Gaps, mistakes or inconsistent entries may affect summaries and trends.


4. Medical disclaimer

Pain Journey is not a medical device and does not diagnose, treat, cure or prevent any medical condition. It does not predict illness, triage symptoms, recommend treatment or verify that a medicine is suitable or has been taken safely.

Pain Journey and its summaries are not medical advice and are not a substitute for advice, diagnosis or treatment from a doctor, pharmacist or other qualified healthcare professional. Always seek professional advice about a medical condition or medicine. Do not disregard or delay seeking medical advice because of information shown in the app.

Pain Journey is not an emergency service and is not monitored by Benchwink or a healthcare professional. In the UK, call 999 in a life-threatening emergency. Use NHS 111 or another appropriate healthcare service for urgent medical help that is not a life-threatening emergency. Outside the UK, use the relevant local service.


5. Your diary and responsibilities

You control what you enter. You are responsible for:

- deciding whether Pain Journey is suitable for your personal record keeping;
- checking entries before relying on or showing them to someone;
- using professional judgement rather than treating an app summary as a clinical conclusion;
- keeping your phone and backup files secure;
- remembering portable-backup passwords; and
- keeping any backup copies you consider necessary.

Do not use Pain Journey as the sole place to store information that you may urgently need or that another person is legally required to retain.

Benchwink cannot view or recover diary information stored only on your device. Benchwink cannot recover a forgotten portable-backup password.


6. Licence to use the app

Subject to these terms and any applicable Google Play rules, Benchwink grants you a limited, personal, non-exclusive, non-transferable, revocable licence to install and use Pain Journey on compatible Android devices for your own lawful, non-commercial purposes.

You may not:

  • copy, sell, rent, sublicense or commercially exploit the app except where the law expressly permits;
    - reverse engineer, decompile or attempt to extract source code except where applicable law gives you a right that cannot be excluded;
    - bypass or interfere with purchase checks, access controls or security features;
    - use the app to introduce malicious code, disrupt a service or infringe another person's rights;
    - impersonate Benchwink or suggest that your use is endorsed by Benchwink; or
    - use Pain Journey in an unlawful, fraudulent or abusive way.


7. Intellectual property

Pain Journey's software, interface, illustrations, icons, name and other materials are owned by Benchwink or its licensors and are protected by intellectual-property law.

You retain any rights you have in the information you enter. Using Pain Journey does not transfer ownership of your diary to Benchwink.

If you send feedback or suggestions, you permit Benchwink to consider and use them to improve Pain Journey without an obligation to pay you. Do not include confidential information or another person's personal information in feedback.


8. Free features and Plus preview

Pain Journey includes a core diary that can be used without a paid Plus purchase. The exact set of free and Plus features is shown in the app.

New users may receive a 30-day Plus preview. This in-app preview does not automatically become a paid purchase. When it ends, Plus-only features become restricted unless Plus has been purchased. Your existing diary, backups and deletion controls remain available as described in the app.

We may change which additional features form part of Plus for future use, but we will not remove statutory rights or intentionally prevent you from accessing or deleting your locally stored diary. Material changes will be communicated appropriately.


9. Subscriptions

Pain Journey may offer a monthly Plus subscription through Google Play. The exact price, currency, billing period, any introductory offer and next charge date are displayed by Google Play before you confirm the purchase.

A subscription renews automatically until cancelled. You can manage or cancel it through your Google Play account. Uninstalling Pain Journey does not cancel a subscription.

Cancellation normally takes effect at the end of the current paid billing period shown by Google Play. You retain Plus access until then unless Google Play states otherwise.


10. One-time Plus unlock

Pain Journey may offer a one-time Plus unlock through Google Play. The price and scope of that purchase are displayed before confirmation. It is not a recurring subscription.

The unlock is associated with the Google account used for the purchase and can normally be restored on compatible Android devices using that account, subject to Google Play's rules and continued app compatibility. It is not transferable to a different Google account and does not create a Benchwink account.

"One-time" means that the purchase does not renew. It does not guarantee that Pain Journey, every feature or compatibility with every future device or Android version will be available indefinitely.


11. Payment, cancellation and refunds

Google Play processes app purchases. Benchwink does not receive your full payment-card details.

Payments, cancellation and refund requests are handled in accordance with Google Play's terms and applicable consumer law. Nothing in these terms limits a refund, cancellation right, remedy or other consumer protection that the law says cannot be limited or excluded.


12. Updates and compatibility

Pain Journey requires a compatible Android device. Features may vary because of device hardware, screen shape, Android version, security settings, accessibility settings, Google Play availability or third-party storage and backup providers.

We may provide updates to fix problems, improve security, maintain compatibility or change features. You may need to install an update to continue using all features. We do not promise compatibility with every device or every future Android release.


13. Backups and third-party services

Android backup, device transfer, Google Play, email and document-storage providers are third-party services. Their availability and performance are outside Benchwink's direct control and their own terms and privacy notices apply.

A portable backup is encrypted with the password you choose and stored at the location you select. You are responsible for its password, availability and deletion. Benchwink cannot open or recover it for you.

No backup method is guaranteed to prevent every loss or corruption. Check that important entries have restored correctly before deleting the original copy or device.


14. Availability and changes

We aim to keep Pain Journey useful and available, but we do not promise that it will always be uninterrupted, error-free or available in every country. We may suspend, withdraw or change parts of the app where reasonably necessary for security, legal, technical or commercial reasons.

Where reasonably possible, we will provide notice of a material change that adversely affects paid functionality. This does not affect any rights or remedies you have under applicable consumer law.

 

15. Our responsibility to you

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation. Nothing in these terms affects your mandatory consumer rights.

Benchwink is responsible for loss or damage that is a foreseeable result of our breach of these terms or our failure to use reasonable care and skill. We are not responsible for loss or damage that is not foreseeable, for business losses arising from personal use of the app, or for loss caused by circumstances outside our reasonable control.

Because Pain Journey is a self-recorded diary rather than a clinical service, Benchwink is not responsible for medical decisions, treatment decisions or emergency action taken or not taken on the basis of an entry, trend, summary or failure to use the app. This does not exclude responsibility that applicable law does not allow us to exclude.

You should maintain appropriate backups. Benchwink is not responsible for data loss caused by a forgotten password, deletion by a user, loss or failure of a device, or failure of a third-party backup or storage provider, except to the extent caused by Benchwink's breach of these terms or failure to use reasonable care and skill.

 

16. Ending your use

You may stop using Pain Journey at any time and may delete its local information using the in-app controls. Uninstalling the app does not cancel a Google Play subscription or delete portable backups saved elsewhere.

We may end or restrict your licence if you seriously or repeatedly breach these terms, misuse the app or if continuing to provide it would be unlawful or create a material security risk. Where appropriate and reasonably possible, we will give you notice and an opportunity to correct the breach.

Sections that by their nature should continue after your use ends, including intellectual property, payment obligations already incurred and applicable limitations of responsibility, will continue.

 

17. Privacy

Our Pain Journey privacy notice explains how information is handled. It forms an important part of your understanding of the app but is not intended to reduce any rights you have under data-protection law.

 

18. Changes to these terms

We may update these terms to reflect changes to Pain Journey, Google Play, the law or our business. The latest version will be published on this page with a revised date.

If a change is material, we will provide reasonable notice through the app or another appropriate route. If you continue to use Pain Journey after the change takes effect, the updated terms will apply, subject to your mandatory legal rights.

 

19. Governing law and disputes

These terms are governed by the law of England and Wales. If you live elsewhere in the United Kingdom or another country, you retain any mandatory protections given by the law of the place where you live.

The courts of England and Wales will have non-exclusive jurisdiction. This means that, where applicable consumer law allows, you may also bring a claim in the courts of the part of the United Kingdom or country where you live.
